Acceptance of the Privacy & Cookies Policy

This Privacy & Cookies Policy (hereafter “The Privacy Policy”) are a binding contract between Aaron Rodilla (hereafter “BrainTesting”), the owner of the site whose ID Card is “NIF B87919625”, with business domicile address at Carrer de Rocafort 82, 1º-1, 08015, Barcelona, Spain, and the users of the website www.brain-testing.org and its services on the other.

   The object of the policy is to regulate the treatment of personal data that is provided by the users of the site.
   

What is the goal of the privacy policy?

1. The goal of the privacy policy is to regulate but also inform the user of the way BrainTesting obtains, processes and protects the personal data provided by the users or obtained directly by BrainTesting through forms, cookies or any other technical form. 
   
2. When you use our services, and specially when you buy and use our IQ Testing service, you will data willl be processed in the form and manner herein established as well as in the terms of use, always with the goal of providing the contracted service.
   
3. BrainTesting is the owner of the website but also has agreements with third-party providers, whose privacy policy may affect you too. These are privacy-protecting providers, and you can check those providers in other questions of this Privacy Policy. 
   

What is the standard of privacy?

1. BrainTesting complies with all laws related to privacy in the countries that it operates. To be more specific we comply with the General Data Protection Reglament (“GDPR”) from the European Union, which is the highest privacy standard currently. Therefore we also comply with other standards such as the California Consumer Privacy Act (“CCPA”) as well as other United States regulations.
   

Is BrainTesting the controller of personal data?

1. BrainTesting is a trademark as stated above, therefore the controller of the site is Aaron Rodilla (hereafter “BrainTesting”), the owner of the site whose ID Card is “NIF B87919625”, with business domicile address at Carrer de Rocafort 82, 1º-1, 08015, Barcelona, Spain.
   
2. It acts as the Data Protection Officer for all subject-matters related to privacy. If you want to contact BrainTesting for any data issue, please write us an email with the subject “Privacy” through the Contact page. 
   

For which purposes do you process personal data?

1. To understand the use of our website and be able to monitor its performance and detect any bug or technical issue and fix it, as well as to understand behavior and be able to find pain points in our user experience so that we can come up with improvements to our service.
   
2. To attribute channel origin to our marketing campaigns, we might process some personal data, so that we can know from which website the user came and what the users action on our website were, what allow us to optimize further the campaigns.
   
3. To provide upon your request our IQ service, we need some personal data in order to create an IQ Certificate and deliver it to you.
   
4. To process payments for the IQ service, as well as refund any payment or dispute/refund chargebacks, we do need to process some of the personal data that we gather from our users. 
   
5. To respond to any customer service or inquiry made to us, will need to process some personal data.
   
6. For security reasons to try to prevent DDoS, malware and any kind of attack.
   
7. Additionally to the processing purposes stated throughout the policy, BrainTesting may process your personal data in a manner consistent with any necessity to provide the service or respond a request of the user. 
   

What personal data do you collect?

1. Although of course this can depend on a specific user requests or contact, we usually have the following data of a client: 
   - First Name
   - Surname
   - Email
   - Country
   - City
   - IP Address
   - IQ Score (this is personal data generated by the platform itself)
   - Operating System (type and version)
   - Device type
   - Language preferences
   - Web browser
   

How long do you keep personal data?

1. After approximately one year we delete your personal data, in order to prevent having unneeded data in our systems, what would increment any type of risk unnecessarily. However, if for any reason, like for example fee dispute, it is necessary to extend this period of time, we will extend it as neeed taking into account the context and legal limitations that apply. 
   

Does BrainTesting share my personal data? Is BrainTesting keeping data confidential?

1. Absolutely NOT. BrainTesting will keep complete confidentiality over you data and will not sell it, communicate it or otherwise transfer it in any way. We can guarantee that we and our partners adopt the necessary protective measures to prevent any type of data breach or loss in accordance with privacy regulations across the globe. Also, we delete your data one year after latest use in order to be protective with it. 
   
2. There are two obvious exceptions to the rule stated above:
   

1. Judicial authorization that complies with current national and international standards and that requires on the part of BrainTesing to transmit user data to the authorities.
   
2. Emergency situation, communicated by the police authorities, by the user's relatives or by third parties who have knowledge of facts related to the user, and when the personal data held by BrainTesting would be of help to solve the emergency.
   

How secure is BrainTesting?

1. BrainTesting uses third-party providers that are considered of the best-class in the industry. Keep in mind that total and complete security does not exist. But our providers and us use the best technology available to keep your data stored safely and to mitigate any risks. Our data basically relies on Amazon Web Services, which is the best cloud provider in the world with the best security. 
   

Do you send marketing communications?

1. We currently do not send any type of marketing email, mail, SMS or other electronic communication. We do however contact you by email to send you your certificate as well as for any inquiry for which you contact us.
   

Are you responsible for third-party links?

1. Our website contains links to other websites, we are not liable once you leave our website for any data processing or activity that you or that third-party executes. We advise you to read their privacy policy since it may differ substantially from us and is a different legal contract. 
   

What are my privacy rights?

1. Access right: you can obtain at any moment all of the data that we have from you so that you are aware of the latest up-to-date status of your data. 
   
2. Rectification right: you may request that we modify your personal data at any moment. Understand that this does not include the service of modifying your IQ results if no mistake was done. 
   
3. Information right: you may request that we provide you with any information regarding the processing of your personal data that is not already specified in the privacy policy.
   
4. Erasure right: you may request us to erase all of your data, in which case we will only maintain necessary data for any legal issue that could arise.  
   
5. Other rights such as portability of your data or to limit the processing.  
   

1. You can always file a claim with the Spanish Data Protection Agency (www.aepd.es) if you consider that we have not resolved properly your request.
   
2. Obviously, exercising your rights is completely free. We do require that you submit a copy of your identification card (ID) that proves your identity. Also you must contact us from the email from which the user submitted the personal data, unless exceptional circumstances are proved. 
   

What are cookies and do you use them on your site?

1. Yes, our website does use Cookies. Cookies are small computer files that are downloaded to the device with which the platform is accessed, both PC and mobile device, in order to allow BrainTesting to carry out any of the data processing purposes and activities detailed in this policy. We will always try to preserve the privacy of users as much as possible.
